1. Acceptance of Terms

By ordering a FreeTapTest kit, submitting a water sample, or accessing the FreeTapTest.org website (the “Site”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use this Site or the free water screening service. These Terms constitute a binding agreement between you (the “User”) and Ode Body LLC (doing business as FreeTapTest.org) (“Company,” “we,” or “us”).

2. Description of Service, Eligibility, and Protocol Limits

The service is a Residential Mapping Sponsorship available only to individuals 18 years or older who are the primary legal property owners of a single-family detached residential dwelling located in the continental United States. We may limit the number of kits per person, address, or household, and may refuse requests we believe are abusive, fraudulent, or duplicative.

Infrastructure Compatibility: Eligibility is restricted to properties with independent residential plumbing infrastructure. We do not ship kits to, or provide analysis for, multi-unit apartments, attached condominiums with shared communal intake, or commercial/industrial facilities.

Shipping Restrictions: We do not ship kits to P.O. Boxes, or to locations in Alaska, Hawaii, or U.S. territories.

Abuse and Fraud: We reserve the right to refuse or cancel requests that do not meet these technical infrastructure requirements, or those we deem abusive, fraudulent, or duplicative.

The Forensic Protocol: Upon approval of your property profile, we will dispatch a forensic collection kit. You are responsible for following the enclosed protocol to capture a tap water sample and returning it to the designated laboratory.

Logistical Contribution: To maintain the sponsorship of the $250 laboratory fee, users are responsible for the direct-to-carrier dispatch costs (postage) required to return the sample in the provided forensic packaging.

Analytical Scope: The "Independent Lab Analysis" is a screening performed via Ode Body LLC’s laboratory process and is not conducted by sales entities. The protocol provides a residential baseline for specific indicators:

Metals and Minerals: Lead, Manganese, Iron, Total Hardness.

Inorganic Compounds: Nitrate, Fluoride, Total Dissolved Solids (TDS).

Disinfectant Residual: A chlorine test strip is provided for onsite user assessment.

Exclusions: This screening is for analytical mapping only and does not include microbiological (bacteria) analysis, pH testing, or comprehensive chemistry beyond the listed parameters.

3. Informational Purpose Only – No Certification or Safety Guarantee

All testing and results provided through FreeTapTest.org are for informational and educational purposes only. This service does not provide medical advice, diagnosis, or treatment. This service is a preliminary screening tool and not a certified laboratory test. The analysis is performed using professional laboratory instrumentation and analytical techniques commonly used in research and commercial labs, but the results are not certified for accuracy or regulatory compliance. Results cannot be used to certify your water as safe or unsafe for drinking or any other use. In particular, results must not be used for official compliance reporting, real estate transactions requiring state-certified water tests, or any legal or regulatory purposes. The Company makes no claim that the water is potable or meets any health or safety standards based on this screening alone. We strongly urge you to consult a state-certified laboratory or your local health authorities for any definitive water safety testing or if you require results for regulatory purposes.

Not a Substitute for Certified Testing: This free screening service is not a substitute for certified laboratory testing. If your report indicates contaminant levels of concern (for example, above U.S. EPA Maximum Contaminant Levels or other health-based guidelines), we recommend that you obtain a confirmatory test from a state-certified drinking water lab before taking any remedial action or incurring expenses for treatment or equipment. In other words, confirm all alarming results through certified testing prior to making decisions about your water supply.

4. User Responsibilities for Sample Collection and Shipping

Proper Use of Kit: You agree to follow all instructions provided with the sampling kit for collecting your water sample. Use the containers and packaging materials supplied to ensure the sample’s integrity during transit. Users are responsible for purchasing and paying for return postage directly with USPS or another carrier of their choice. Any labels included in the kit (if provided) are address labels only and do not include postage unless explicitly stated. We recommend shipping the sample as soon as possible (preferably within the same day of collection) via the suggested shipping method (e.g., 2-day priority) to maintain sample quality.

Packaging and Sealing: You are responsible for properly sealing and packaging the sample according to the instructions. Any leakage or damage caused by improper packaging is the User’s responsibility. You agree to indemnify and hold the Company harmless from any liability, damage, or carrier fees resulting from your failure to properly seal or package the sample. This means that if the sample container leaks, breaks, or is improperly packed by you, and it causes a spill or any hazard during shipping, you – not the Company – will be responsible for any resulting damages, cleanup costs, or regulatory fines.

Timely Shipment: The Company is not responsible for delays in transit or any failure of the shipping carrier to deliver the sample promptly. Once you ship your sample, it is under the control of the postal service or courier. Shipping delays, lost packages, or mishandling by the carrier are outside our control, and the Company assumes no liability for such issues. It is your responsibility to provide the carrier with the package in good condition and to use the provided tracking (if any) to monitor delivery.

Ownership: Upon receipt, your sample and any remaining portion becomes the property of the Company for purposes of analysis, quality control, and disposal. We may dispose of samples and related materials after testing.

5. Sample Integrity and Scientific Limitations

Unpreserved Samples: The water samples collected for this screening are unpreserved (no chemical preservatives are used in the kit). This approach is intended to keep the kit safe and simple for consumers; however, it means certain analytes can change over time. You acknowledge that because no preservatives are added, parameters in the water may change during shipping (e.g., some metals can adhere to container walls or oxidize, and chlorine residuals can dissipate).

Holding Times and Degradation: You understand that water quality parameters have recommended “holding times” – the maximum time between sample collection and analysis – especially for volatile or biological measurements. Shipping the sample to our lab may cause some holding times to be exceeded, which can affect the accuracy of certain results. For example, chlorine levels can decrease rapidly after collection, and other characteristics (like iron or turbidity) may change if the sample sits too long. User acknowledges that any such delays are beyond the Company’s control. Therefore, results for time-sensitive parameters are provided as estimates only and may not reflect the exact conditions at the time of sampling. The Company disclaims any liability for changes in sample composition due to shipping time or environmental factors during transit. Our service focuses on more stable chemical analytes to mitigate this issue, but any result could be affected by the passage of time.

No Bacteria/PH Analysis: As noted, the kit does not include tests for bacteria or pH, which are particularly time-sensitive. We have excluded these tests specifically because shipped samples would not meet the strict 30-hour holding time for bacteria or the immediate testing needed for pH. By limiting the service to more stable parameters (e.g., metals, nitrates), we aim to provide useful information while acknowledging scientific limitations. Do not rely on this screening for any parameter that requires immediate analysis or certified methods.

Unusable Samples: We may determine that a sample is unusable due to leakage, insufficient volume, contamination, improper container use, or excessive transit time. In such cases, we may decline to issue results and may (at our discretion) allow a resubmission. Because the service is free, the Company has no obligation to provide repeat kits or additional processing.

6. Testing Methodology and Equipment Disclaimer

Our laboratory utilizes professional-grade analytical instruments (such as spectrophotometers, electrochemical probes, anodic stripping voltammetry, or other standard methods) to analyze your water sample. While this equipment is similar to that used in certified labs or academic research, the context of an at-home collected, shipped sample imposes practical limits on data quality. Field conditions, user sampling error, shipping variables, and the lack of on-site preservation can all impact the accuracy and precision of the results.

No Warranty on Results: The Company makes no warranty, express or implied, regarding the accuracy, precision, or completeness of the test results. All results are provided “as is” for informational purposes. We do not guarantee that the screening results will be identical to results from a certified laboratory using official EPA methods, nor that they will meet any particular standard of quality or performance. Any implied warranties, including warranties of merchantability or fitness for a particular purpose, are expressly disclaimed to the fullest extent allowed by law. In particular, the Company does not warrant that the testing service will identify all contaminants or issues in your water, or that the results will assure any specific water quality outcome.

General Recommendations Only: Along with your lab report, we may provide general information or common practices for addressing certain water quality issues (for example, we might note that “high hardness was observed; a water softener is a typical solution”). Any such recommendations are meant as general suggestions based on common water treatment practices, not specific advice for your situation. We strongly advise that any significant remediation decisions or equipment purchases be made only after a site-specific evaluation by a qualified water professional. In other words, a licensed water treatment specialist should confirm what solution is appropriate for your specific water system before you invest in any equipment or services. The Company does not guarantee that any suggested remedy or product will work for your particular water issues, and we assume no liability if a suggested treatment does not have the intended effect.

Testing Standards: Reference guidelines shown (including EWG guidelines and California PHGs) are provided for informational context only. They are not federal drinking water compliance standards and may differ substantially from EPA Maximum Contaminant Levels (MCLs) and other state or local benchmarks. Do not treat these reference values as a determination of potability or regulatory compliance.

7.1 One-to-One Partner Match and Data Sharing

As part of the FreeTapTest.org program, your water test results may be reviewed with a third-party water filtration specialist (a “Partner” or “Expert”) matched to your area based on ZIP code. At the time you request a kit, we will display the Partner’s name/company. If you provide consent, we will share your contact information and your test report with that single identified Partner so they can review the results and contact you to discuss potential treatment options. We do not distribute your information to multiple contractors or a network of sellers.

This free kit program is funded in part through this one-to-one referral model. Consent to Partner contact is required to receive the free kit and results review. Partners may offer water treatment products or services for sale, and any purchase is optional.

7.2 What “Vetted” Means (and What It Does Not Mean)

“Vetted” means that, at the time a Partner is onboarded, we confirm that the Partner (i) appears as an active member of the Water Quality Association (WQA) (or an equivalent professional organization), (ii) is in good standing with the Better Business Bureau where available, and (iii) has an average Google rating above 4.6 where available.

Vetting is limited and is not an endorsement. We do not guarantee a Partner’s workmanship, advice, pricing, outcomes, availability, or ongoing reputation, and we do not supervise, direct, or control any Partner services.

7.3 Independent Third Party; No Responsibility for Partner Services

Partners are independent third parties and are not employees, agents, joint venturers, or representatives of Ode Body LLC. Any interaction, quote, purchase, or service arrangement between you and a Partner is solely between you and that Partner. Ode Body LLC is not a party to any agreement you may enter into with a Partner, and we do not provide warranties regarding any Partner products or services.

7.4 Release; Assumption of Risk

If you choose to communicate with, hire, or purchase products or services from a Partner, you do so at your own discretion and risk. To the maximum extent permitted by law, you release and hold harmless Ode Body LLC and its affiliates from any claims, injuries, damages, losses, or disputes arising out of or relating to a Partner’s advice, recommendations, products, or services. Any disputes regarding a Partner must be resolved directly with that Partner.

 

8.1 Consent Required to Participate in the Free Program

As described in Section 7, this free kit program is funded in part through a one-to-one referral model. To receive the free kit and results review, you must provide consent to be contacted by the matched Partner identified to you at signup. If you do not consent, you should not request the free kit.

8.2 Identity of the Caller (Named Partner; One-to-One)

At the time you request a kit, we will display the Partner’s name/company. Your consent applies only to that specific named Partner. We do not share your information with multiple contractors, lead-buying networks, or generic call centers.

8.3 Scope of Consent (Phone, SMS, Email)

By checking the consent box and submitting the kit request form, you provide express consent for the specific named Partner to contact you using the phone number and email address you provided for the purposes of (i) reviewing your water test results, and (ii) providing information about potential water treatment options, products, or services. This contact may include phone calls, text messages (SMS), and emails. Calls and texts may be made using automated technology, including automated dialing systems or prerecorded/artificial voice messages, depending on the Partner’s contact systems. Consent is not a condition of purchasing any goods or services. The Partner is responsible for complying with applicable telemarketing laws and honoring opt-out requests.

8.4 No Purchase Required

You are not required to purchase any product or service from the Partner. Your consent allows the Partner to contact you to discuss results and options, but it does not obligate you to buy anything.

8.5 Opt-Out and Revocation of Consent

You may revoke your consent at any time. For text messages, you may reply “STOP” to opt out. For emails, you may use the unsubscribe mechanism provided in the email (if applicable). You may also request that the Partner stop contacting you, or you may contact us at support@freetaptest.org to relay your opt-out request. Revoking consent will stop further outreach, but it will not affect the test results already provided.

8.6 Carrier Charges

Message and data rates may apply depending on your mobile carrier and plan.

9. Disclaimer of Warranties

“As Is” Service: The FreeTapTest service, the Site, and all information, reports, and recommendations we provide are offered “as is” and “as available,” without any warranties of any kind. To the maximum extent permitted by law, the Company disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service or results will meet your requirements or expectations. We do not warrant that the Site will be error-free or uninterrupted, or that any defects will be corrected. While we endeavor to provide accurate and reliable information, we make no warranty that the water testing results or any content provided are completely accurate, reliable, or up-to-date.

No Guaranteed Outcomes: The Company provides no guarantee or assurance that using our service will result in any specific outcome for your water quality. For example, we do not guarantee that your water will be deemed safe, or that any treatment recommendations will resolve your water issues. Any equipment or treatment recommendations are offered as general guidance only, without any guarantee as to their effectiveness for your particular situation. The entire risk arising from use of our service and reliance on the results or suggestions remains solely with you, the User.

Not Professional Advice: Except for the limited laboratory analysis of your sample, no part of our service constitutes professional health, safety, or engineering advice. The information provided is not a replacement for consultation with qualified experts. Always exercise your own judgment and consider consulting certified laboratories, water quality specialists, or health officials for advice on drinking water safety and treatment. The Company does not warrant or represent that following any information from us (or from the referred Partner) will achieve any particular outcome.

10. Limitation of Liability

To the fullest extent permitted by law, Ode Body LLC (FreeTapTest) shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the service, the Site, or your reliance on the test results. This includes, without limitation, any health problems, property damage, plumbing issues, loss of value, or any costs (such as medical expenses or water system repair costs) that you believe are due to the information we provided or any delay or error in providing the service. We cannot be held responsible for any harm or losses that result from you acting (or failing to act) on the basis of the screening results.

Our maximum liability to any user shall not exceed the total amount the user paid directly to the Company for the FreeTapTest service during the twelve (12) months preceding the event giving rise to the claim. Because the FreeTapTest kit and analysis are provided at no charge by the Company, this amount will typically be $0.

Some jurisdictions do not allow certain liability exclusions or limitations. To the extent that any such law applies to you, some of the above exclusions or limitations may not apply, and in that case our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Ode Body LLC (and its officers, directors, employees, contractors, and agents) from and against any and all claims, liabilities, losses, expenses, damages, and costs (including reasonable attorneys’ fees) that arise out of or relate to: (a) your use of the Site or the FreeTapTest service, (b) your violation of these Terms, (c) your violation of any law or regulation, or (d) your negligence or misconduct in collecting, handling, or shipping your water sample. This includes, for example, any claims or costs arising from spillage or damage caused by your improper packaging of the sample, or from your misuse of the test results contrary to the disclaimers provided. The Company reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), in which event you agree to cooperate with our defense of such claim. You agree not to settle any such matter without the prior written consent of the Company.

12. Governing Law and Dispute Resolution

Governing Law: These Terms and your use of the service are governed by the laws of the State of Tennessee, without regard to its conflict of law principles. This means that the laws of Tennessee will apply to any disputes, regardless of where in the U.S. you reside or use the service.

Arbitration Agreement: You and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the service shall be resolved exclusively through final and binding arbitration, not in court (except for matters that may be taken to small claims court). The arbitration will be conducted in or near Nashville, Tennessee (or another location mutually agreed upon) before a single arbitrator, in accordance with the rules of the American Arbitration Association (AAA) or another established arbitration provider. By agreeing to arbitration, both parties waive the right to a trial by jury or to have the dispute decided by a judge. 

Arbitration Opt-Out: You may opt out of this arbitration agreement within thirty (30) days of first accepting these Terms by sending written notice to: Ode Body LLC, 922 Main St. STE C #423, Nashville, TN 37206, Attn: Arbitration Opt-Out, and emailing a copy to support@freetaptest.org. Your notice must include your name, the email and phone number used to request the kit, and a clear statement that you wish to opt out of arbitration. Opting out does not affect any other provisions of these Terms.

Class Action Waiver: All arbitrations shall be conducted on an individual, case-by-case basis. You waive any right to participate in a class, collective, or representative action against the Company. The arbitrator shall not consolidate the claims of multiple individuals or preside over any form of a representative or class proceeding. You agree that you may bring claims against us only in your individual capacity, and not as a plaintiff or class member in any purported class or collective proceeding.

Exceptions: Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidentiality obligations. Also, disputes relating to the scope or 

enforceability of the arbitration clause, or the class action waiver, may be resolved by a court and not the arbitrator if required by applicable law.

Jurisdiction: Subject to the arbitration provision, you agree that any judicial proceedings (to the extent they are allowed to proceed in court) will be brought in the state or federal courts located in Tennessee, and you consent to personal jurisdiction and venue in such courts.

13. Changes to Terms

The Company reserves the right to modify or update these Terms at any time. If we make material changes, we will post the updated Terms on this page with a new “Last Updated” date and, if appropriate, provide additional notice (such as a notice on our homepage or via email). Continued use of the Site or the service after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms whenever you use the service to stay informed of any updates. We may modify, suspend, or discontinue the service (including analytes tested) at any time.

14. Miscellaneous

Entire Agreement: These Terms (along with any other policies or guidelines posted on the Site, such as our Privacy Policy) constitute the entire agreement between you and the Company regarding the FreeTapTest service and supersede any prior agreements or understandings, whether written or oral.

Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from the Terms and will not affect the validity and enforceability of the remaining provisions.

No Waiver: The failure of the Company to enforce any right or provision of these Terms shall not operate as a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Ode Body LLC.
