This Privacy Policy describes how Ode Body LLC d/b/a FreeTapTest.org (“FreeTapTest,” “Company,” “we,” “us”) collects, uses, discloses, and protects information in connection with FreeTapTest.org (the “Website”) and the services we provide, including sending sampling kits, receiving submitted samples, performing water screening analysis, delivering results, and enabling a one-to-one results review with a local water filtration specialist (collectively, the “Services”). This Privacy Policy is incorporated by reference into our Terms and Conditions.

By using the Services, you acknowledge and agree to the practices described in this Privacy Policy.

Scope; Not HIPAA; Not Medical Services

The Services are consumer informational screening services. We are not a “covered entity” under HIPAA, and information handled through the Services is not “protected health information” under HIPAA. The Services do not provide medical advice, diagnosis, or treatment.

Information We Collect

2.1 Information You Provide

We may collect the following categories of information when you use the Services:

• Identifiers and contact information (e.g., name, email address, phone number)

• Shipping and location information (e.g., mailing address, ZIP code; and derived region for Partner matching)

• Consent and communication records (e.g., your consent selections, timestamped consent records, opt-out requests)

• Customer support communications (e.g., messages you send us)

2.2 Sample and Results Information

When you submit a sample, we may collect and generate:

• Sample identifiers (e.g., sample ID and internal processing metadata)

• Screening results and report content for the analytes included in the program

• Operational and quality-related notes (e.g., condition on receipt, insufficient volume, excessive transit time)

2.3 Information Collected Automatically

When you visit the Website, we may collect:

• Device and network information (e.g., IP address, device type, browser type, operating system)

• Usage and interaction information (e.g., pages viewed, clickstream data, time spent, referring/exit pages)

• Approximate location inferred from IP (generally city/state level)

We use cookies, pixels, and similar technologies, including Google Analytics and Meta Pixel, to operate the Website, measure performance, and evaluate marketing effectiveness.

How We Use Information

We use information as reasonably necessary to:

• Provide and administer the Services (send kits, receive samples, generate and deliver results)

• Enable the “results review” experience and one-to-one Partner matching where you provide consent

• Communicate with you about your request, kit logistics, and results delivery

• Maintain quality, integrity, and security of the Services (including fraud/abuse prevention)

• Improve and develop the Services and user experience

• Comply with law and enforce our agreements (including the Terms and Conditions)

How We Disclose Information

4.1 One-to-One Partner Disclosure (Named Partner)

If you request a kit and provide consent, we disclose your contact information and test report to one (1) specific third-party filtration specialist (the “Partner”) that is identified to you by name/company at the time you request the kit. The Partner may contact you by phone, SMS, and/or email consistent with your consent.

We do not distribute your information to multiple contractors, lead networks, or a generic call center as part of this program.

4.2 Service Providers (Processors)

We may disclose information to third parties that perform services on our behalf (e.g., hosting, analytics, communications delivery, security, customer support tooling, operations systems). These parties are authorized to use information only as necessary to provide services to us and subject to contractual protections.

4.3 Legal, Safety, and Business Transfers

We may disclose information if we believe in good faith it is necessary to:

• comply with applicable law, regulation, or legal process

• protect rights, safety, and security of users, the public, or the Company

• investigate and prevent fraud, misuse, or security incidents

• support a corporate transaction (e.g., financing, reorganization, sale, merger, acquisition). Information may be transferred as part of that transaction, subject to standard protections.

Cookies, Pixels, Analytics, and Targeted Advertising

5.1 Cookies and Similar Technologies

We use cookies and similar technologies to operate the Website, understand usage, and measure marketing performance. Your browser may allow you to control cookies; blocking cookies may impact functionality.

5.2 Important Note About Results Data

We do not provide your individual test results to analytics or advertising platforms for their independent use. Website tracking tools generally receive online identifiers and event data (e.g., page views, button clicks) and may receive your IP address and device identifiers when you visit the Website.

“Sale” / “Share” of Personal Information (State Privacy Laws)

Some state privacy laws define “sale” broadly and define “share” as disclosure for cross-context behavioral advertising.

• We do not sell your personal information for money.

• We may “share” certain online identifiers and Website interaction data (e.g., via cookies/pixels such as Meta Pixel) for purposes of measuring and improving advertising effectiveness, which may be considered “sharing” under certain state laws.

You may opt out of such “sharing” / targeted advertising as described in Section 9.

For clarity: disclosure of your information to a single named Partner for results review (with your consent) and disclosure to vendors acting as our service providers are not “sales” in the ordinary sense; they are part of providing the Services.

Communications; Consent; Opt-Out

7.1 Service/Operational Messages

We may send transactional or operational communications (e.g., confirmations, results delivery, program notices). These are necessary to provide the Services.

7.2 Partner Communications

If you consented, the named Partner may contact you regarding your results and potential treatment options.

You may revoke consent at any time:

• SMS: reply “STOP” (or equivalent instruction provided in the message)

• Email: use the unsubscribe mechanism provided (if applicable)

• Direct request: ask the Partner to stop contacting you

• Contact us: email support@freetaptest.org

 and we will relay your opt-out request to the Partner as a courtesy

Opting out stops future outreach but does not affect results already delivered.

Data Retention

We retain information for as long as reasonably necessary for legitimate business purposes, including providing the Services, maintaining records of consent and program integrity, security, dispute resolution, and legal compliance. We may delete or de-identify information when it is no longer needed.

Your Privacy Choices and Rights

9.1 Opt-Out of Targeted Advertising / “Sharing”

You can opt out of cookies/pixels used for cross-context behavioral advertising by:

• using browser controls to block third-party cookies and similar technologies

• using platform opt-out mechanisms where available

• requesting assistance via support@freetaptest.org

9.2 Access, Deletion, Correction (Where Applicable)

Depending on your state of residence, you may have the right to request:

• access to certain personal information we hold about you

• correction of inaccurate personal information

• deletion of certain personal information

• information about disclosures of personal information

• an opt-out of targeted advertising / certain profiling activities (as applicable)

To make a request, contact us (Section 12). We may require verification of your identity and may deny requests where permitted by law (e.g., where retention is necessary for security, compliance, consent records, or ongoing services).

Security

We implement reasonable administrative, technical, and physical safeguards designed to protect information. No method of transmission or storage is 100% secure; we cannot guarantee absolute security.

Children’s Privacy

The Services are intended for individuals 18 years or older. We do not knowingly collect personal information from anyone under 18.
